Terms of Service

Scope & Agreement

These Terms of Service ("Terms") govern your access to and use of the Relpin platform, including all associated services, APIs, and documentation (collectively, the "Service"), operated by Yan Malinovskiy – Relpin, Kaiser-Joseph-Str. 254, 79098 Freiburg im Breisgau, Germany ("we", "us", "Relpin").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

Business customers only. The Service is directed exclusively at businesses, organizations, and professionals acting in the exercise of their trade or profession (Unternehmer within the meaning of § 14 BGB). It is not offered to consumers. By registering, you confirm that you are acting as a business customer.

Beta status. The Service is currently provided as an open beta. Features may change, be added, or be removed as the platform develops. The Service is provided on an "as available" basis during the beta, and no service level commitments apply (see Section 8). We will announce material changes in advance as described in Section 11.

Account & Access

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at info@relpin.com if you become aware of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account where you have failed to safeguard your credentials.

License & Usage

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with your subscription plan.

This license does not include the right to sublicense, resell, or distribute the Service or any part thereof to third parties, unless expressly authorized in writing by Relpin.

Acceptable Use

You agree not to use the Service in any manner that:

  • Violates any applicable law, regulation, or third-party rights
  • Transmits malicious code, viruses, or any harmful software
  • Attempts to gain unauthorized access to the Service, other accounts, or underlying systems
  • Reverse engineers, decompiles, or disassembles any part of the Service
  • Scrapes, crawls, or uses automated means to access the Service beyond permitted API usage
  • Interferes with or disrupts the integrity or performance of the Service
  • Uses the Service to build a competing product or service
  • Stores or processes data in violation of applicable data protection laws

We reserve the right to suspend or terminate your access if we reasonably believe you have violated these acceptable use requirements.

Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by Relpin and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks or brand elements.

You retain all rights to the data, content, and applications you create using the Service ("Your Content"). You grant us a limited license to host, store, and process Your Content solely to provide and improve the Service.

Payment & Billing

Paid subscription plans are billed in advance on a monthly or annual basis, depending on the plan selected. All fees are stated in euros and are exclusive of applicable taxes unless otherwise noted. Checkout and invoicing are handled by Polar as merchant of record, which calculates, collects, and remits applicable VAT or sales tax based on your location at checkout. EU business customers with a valid VAT ID purchase under the reverse-charge mechanism.

We may change our pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle. If you do not agree with a price change, you may cancel your subscription before the new pricing takes effect.

Refunds are handled in accordance with applicable law and processed through Polar. For subscriptions, you may cancel at any time, and your access will continue until the end of the current billing period. If you believe a charge is incorrect, contact us at info@relpin.com before disputing it with your bank — we resolve billing issues directly. Charges appear on your card statement under Polar, our merchant of record.

Data & Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We process data on infrastructure provided by Cloudflare (hosting and CDN), Neon (PostgreSQL database, EU region — Frankfurt, Germany), and Upstash (Redis). Application and database data is stored within the European Union. Payment processing is handled by Polar as merchant of record; payment data is processed by Polar in accordance with its privacy policy. Availability & SLA

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

During the open beta, no Service Level Agreement (SLA) applies. Enterprise customers may negotiate a separate SLA with defined uptime commitments and remedies after general availability. Contact us for details.

Limitation of Liability

To the maximum extent permitted by applicable law, Relpin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.

Our total aggregate liability for all claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded under applicable law.

Termination

Either party may terminate these Terms at any time. You may cancel your account through the Service settings or by contacting us. We may suspend or terminate your access if you breach these Terms.

Upon termination, you will have 30 days to export your data. After this period, we may delete your data in accordance with our data retention policies. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you at least 30 days in advance via email or through the Service. Your continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top indicates the most recent revision.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Freiburg im Breisgau, Germany, to the extent permitted by law.
